Sarasota Bike Tours Inc. Liability Waiver and Agreement

DISCLOSURE AND ASSUMPTION OF RISK

Sarasota Bike Tours Inc. ["SBT"] is a Florida limited liability company providing
snorkeling trips, eco tours, and sandbar excursions in the Sarasota Bay area. SBT makes every reasonable effort to provide professional experienced guides and quality equipment. Patrons of SBT are advised, however, that boats and the environment in which they operate, present certain inherent and, at times,
unavoidable dangers. These dangers include but are not limited to: equipment
failure, perils at sea, acts of other participants, other water crafts, wave action and ships' wakes, adverse weather conditions, heat or sun related illnesses or injuries, including sunburn, sunstroke, or dehydration, fatigue, chill, and/or dizziness, which may diminish reaction time and increase the risk of an accident and I hereby assume such risks.

I understand that I have a duty to exercise reasonable care for my own safety and I agree to do so. I assert that I am physically fit to ride on a boat and will not hold Sarasota Bike Tours Inc. or their employees, agents, or other associated personnel responsible. Knowing the potential dangers, hazards, and risks involved in the above-described activities, as well as in consideration of their participation in any guided tour conducted by SBT, the undersigned ["Patron(s)"], on the undersigned's own behalf, as well as the undersigned's family, heirs, personal representatives and assigns, hereby:
Assume all risk of injury, property damage, or death resulting from Patron's
engagement in any of the activities described above.

RELEASE OF LIABILITY, INDEMNITY, AND HOLD HARMLESS
I hereby forever release Sarasota Bike Tours Inc. from and indemnify them and
hold them harmless for any and all responsibility or legal liability for any injuries or damages to any user or any equipment whether or not such injuries or damages are caused by the negligence of SBT. I agree not to make a claim against or sue SBT for any injuries or damages relating to snorkeling and/or the use of this equipment and I will accept full responsibilities for those injuries and damages. I have carefully read this agreement.

I am aware that this is a binding contract which provides a comprehensive release of liability. However, it is not intended to assert any claims or defenses that are prohibited by law. This document constitutes the final and entire agreement between Sarasota Bike Tours Inc. and the undersigned.
Sarasota Bike Tours Inc. and the owners and crew of the charter vessels shall not be liable for any loss or injury howsoever caused, whether by reason of fault or negligence of the owners otherwise. I understand and agree that if I am renting equipment and it is damaged beyond normal wear and tear or lost, I may be subject to a replacement or repair fee.

Electronic Signature Consent*
By checking here, you are consenting to the use of your electronic signature in lieu of an original signature on paper. You have the right to request that you sign a paper copy instead. By checking here, you are waiving that right. After consent, you may, upon written request to us, obtain a paper copy of an electronic record. No fee will be charged for such copy and no special hardware or software is required to view it. Your agreement to use an electronic signature with us for any documents will continue until such time as you notify us in writing that you no longer wish to use an electronic signature. There is no penalty for withdrawing your consent. You should always make sure that we have a current email address in order to contact you regarding any changes, if necessary.
